The JC Tefft Foundation (The Foundation) maintains the highest level of respect for the privacy of its Subscribers and contributors. But in order to offer and disseminate its Programs and Services the Foundation is obligated to collect and utilize certain personal information from Subscribers and contributors that might include, but is not limited to, the address, telephone number, e-mail address, and amount contributed, together with comments made by Subscribers and contributors. Tax laws in the United States and the State of Arizona require us to keep contact and contribution information on file. 

Consequently, in furtherance of our commitment to honor your rights in this regard, this Privacy Policy was developed to guide our administrators, volunteers, and staff on how they may and may not use your personal information, as follows: 

What this Privacy Policy covers: 

This covers how the Foundation treats personal information that it collects and receives through its website. “Personal Information” is defined as information about you that is personally identifiable, like your name, address, e-mail address, or phone number, and that is not otherwise publicly available. If we obtain your Personal Information from a third party, such as a business partner, it will also be governed by this Privacy Policy. This Privacy Policy does not apply to the practices of companies that the Foundation does not own or control, or to people that the Foundation does not employ or manage. By using our Site, you signify your agreement with all the terms of this Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not use our Site. 

Regarding the personal data we collect: 

When you register as a Subscriber we ask for information such as your name, e-mail address, mailing address, and phone number. Once you register with the Foundation and sign into our services, you are not completely anonymous to us or to GoDaddy.com. GoDaddy.com automatically receives and records information on their server logs from your browser every time you log in, including your IP address, cookie information, and the page you request. Certain other personal information that you previously recorded with us the Foundation keeps on file to verify your Subscription and keep track of out Subscribers. You may update your Personal Information with the Foundation at any time by visiting your "Profile" contained within the Community Forum once logged in as a Subscriber.  

We reserve the right to send you certain communications relating to Foundation Services, such as service announcements, administrative messages, and communications that are considered part of your Subscription Services, without offering you the opportunity to opt-out of receiving them. 

Regarding children accessing the Site: 

Minors under 18 are not allowed to register with the Foundation website and we do not knowingly collect Personal Information from anyone under the age of 18. If a child does enter the Site by gaining his or her parents’ or guardians’ password, the parent or guardian assumes all liability for the child’s behavior on the Site and the Foundation is indemnified from all claims arising from the child’s access. If a child causes a disturbance while using the account of his or her parent or guardian, the parent or guardian will be held responsible and his or her account may be terminated. 

Regarding sharing or disclosing Personal Information to outside sources: 

The Foundation does not rent, sell, or share Personal Information about you with other people or non-affiliated companies except to provide products or services you request, when we have permission, or under the following circumstances: 

      *  We respond to subpoenas, court orders, or legal processes, or to establish or exercise our legal rights, or to defend against legal claims. 

      * We reserve the right to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving
         potential threats to the physical safety of any person, violations of the Foundation’s “Terms of Use,” or as otherwise required by law. 

      * We might transfer information about you if the Foundation merges with another company. If such an event occurs, the Foundation will notify you before
         information about you is transferred and becomes subject to a different Privacy Policy. 
 
      * We might share information with outside contractors or agents who help us manage our information activities, but only as needed for them to provide                  their services.
        
The Foundation might also display advertisements on web pages of its choosing. Such advertising might assume that people who interact with, view, or click on targeted ads meet the targeting criteria. The Foundation does not otherwise actively provide any Personal Information to the advertisers when you interact with them or view an ad. 

Additionally, the Foundation uses information for the following general purposes: to customize the advertising and content you see, fulfill your request for products and services, improve our services, contact you, and conduct research. 

The Foundation is subject to, but not responsible for the privacy practices of GoDaddy.com (view their Privacy Policy at GoDaddy.com), or websites operated by third parties that may be linked to our Site, or for the privacy practices of Internet advertising companies or advertisers. Once you leave the Foundation’s Site via such a link or by clicking on an advertisement, the Foundation Privacy Policy no longer applies and you should check the applicable privacy of the third party or advertiser website to determine how they will handle any Personal Information they collect from you. 

Regarding cookies uploaded from websites: 

The Foundation does not upload cookies to your computer to track your usage, but GoDaddy.com might for the purposes of garnering statistics related to customer usage of the Site. In any event, the Foundation is not privy to this information, other than in generalized statistical format, and no personal information is otherwise received by the Foundation, nor is it sold or shared with anyone. Other companies that show advertisements on some of our pages might set and access their cookies, which are subject to their own privacy policies, not this one. Visitors to our Site should check the privacy policy of the Internet advertising company or advertiser to see whether and how it uses cookies. Advertisers or other companies do not have access to Foundation information in this regard. 

Regarding data retention policy: 

The Foundation, consistent with its commitment to minimize the data retention of users and Subscribers, adopts the policy of retaining the least amount of personally identifiable information consistent with maintenance of its services, regarding its privacy policy, or as required by state or federal legal provisions under United States of America law. 

Regarding what happens to subscriber Information upon cancellation of a subscription: 

You can remove your credit card information from your profile at any time. However, the Foundation will retain any record of Personal Information that might be required to comply with applicable federal, state, or local law, and residual information might reside in the Foundation’s database, which might or might not contain your Personal Information. 

Regarding confidentiality of Personal Information: 

Access to Personal Information is limited to employees or others who we believe reasonably need to come into contact with that information to provide products or services to you, or in order to do their jobs. Our servers and databases are protected by firewalls and passwords. We maintain the highest level of security made available to us by our service provider, GoDaddy.com. This protection, however, does not include information, such as name, location, and e-mail addresses that you post to the online Community Forum as a comment, which may be viewed by any Subscriber. As regards the Community Forum, you agree that you are posting any and all such information at your sole risk and discretion. We have reasonable physical, electronic, and procedural safeguards that comply with federal regulations to protect Personal Information about you. However, no system is fail-safe. The Foundation cannot guarantee that its servers and service providers are impenetrable, nor can we promise that your information will not be intercepted as it is being transmitted over the Internet. 

Regarding changes made to these policies: 

The Foundation might update this Privacy Policy at any time. We will notify you about changes in the way we treat Personal Information by sending a notice to the primary e-mail address specified in your Foundation account (and sending an e-mail to that address will constitute sufficient notice of the change), or by placing a prominent notice on our Site, and we will post a revised Privacy Policy here on the Site. If you have particular concerns about your privacy you would do well to review this Privacy Policy from time to time so that you are up to date on our most current practices.

The Foundation encourages the sharing of insights and ideas with others, but also requests that users and Subscribers respect the Terms of Use of the Foundation’s website and requires that credit be given where credit is due. We endeavor to respect the intellectual property of others and we ask our users and Subscribers to do the same. The Foundation may, in appropriate circumstances and at its sole discretion, disable and/or terminate the accounts of users who repeatedly fail to comply with this policy.
